  • "Agreement" means these Terms and Conditions together with any engagement letter or service agreement between you and Moradok Tham.
  • "We", "Us", "Our", "Firm" refers to Moradok Tham, a legal practice based at 112 Sathorn Road, Thung Maha Mek, Sathon, Bangkok 10120, Thailand.
  • "User", "You", "Your" means any individual who accesses this website or engages our legal services.
  • "Services" means the inheritance and succession law services offered by Moradok Tham, including Estate Overview Consultations, Will & Succession Planning, and Estate Administration Support.
  • "Website" means the Moradok Tham website and all pages accessible under its domain.
  • "Content" means all text, documents, materials, and information published on this website.
  • "Client" means a User who has entered into a formal engagement with us for the provision of legal services.

2. Acceptance of Terms

By accessing or using this website, you confirm that:

  • You have read and understood these Terms and Conditions.
  • You are at least 18 years of age and have the legal capacity to enter into a binding agreement.
  • You are accessing the website for lawful purposes only.

A formal client relationship is established only upon the signing of a written engagement letter and receipt of any agreed initial fee. Browsing this website or submitting an enquiry does not in itself create a solicitor–client relationship.

3. Service Description

Moradok Tham offers inheritance and succession law services in Thailand, including:

  • Estate Overview Consultation — a confidential initial conversation to understand a family's circumstances and explain how inheritance matters may be approached, accompanied by a written summary. Offered as a supportive first step.
  • Will & Succession Planning — assistance in preparing a legally valid will and setting out succession wishes clearly, with each option explained plainly and all decisions remaining with the client.
  • Estate Administration Support — legal support through the administration of an estate, including documentation, liaison with relevant parties, and representation where required, with scope and costs agreed openly at the outset.

Our services are provided primarily for matters arising under Thai law. We will inform you if your circumstances fall outside this scope. Service availability is subject to the capacity of the firm and the specific circumstances of each matter.

4. Client Responsibilities

To enable us to advise and assist you effectively, you agree to:

  • Provide accurate, complete, and timely information and documentation as reasonably requested.
  • Inform us promptly of any changes in your circumstances that may affect the matter.
  • Settle fees and disbursements in accordance with any engagement letter or agreed payment schedule.
  • Refrain from using any information or advice provided by us for purposes other than the matter for which it was given.
  • Use this website only for lawful purposes, and not to transmit any harmful, fraudulent, or misleading content.

We reserve the right to suspend or decline services where information provided proves to be materially inaccurate or where instructions would require us to act contrary to our professional obligations.

5. Intellectual Property

All content on this website — including text, design, structure, and materials — is the intellectual property of Moradok Tham or used with appropriate permission. This content is protected under Thai intellectual property law.

You are granted a limited, non-exclusive, non-transferable licence to access and view this website and its content for personal, non-commercial reference only. You may not reproduce, redistribute, or create derivative works from any content on this website without our prior written consent.

Documents and written summaries prepared for you as part of our services remain subject to our professional obligations and may not be reproduced or relied upon by third parties without our express written agreement.

6. Fees & Payment

Our service fees are outlined on this website as follows:

All fees are quoted in Thai Baht (THB) and are inclusive of applicable VAT unless otherwise stated. Additional disbursements — such as court fees, Land Department charges, or translation costs — will be agreed in advance and itemised separately.

Payment is due in accordance with the terms set out in the engagement letter. We reserve the right to suspend work on a matter where fees remain outstanding beyond the agreed period.

Fees paid for the Estate Overview Consultation are non-refundable once the consultation has taken place. For other services, refund terms are set out individually in the engagement letter for that matter.

7. Confidentiality

We treat all information you share with us in the course of an engagement as strictly confidential. We will not disclose your personal or legal details to any third party except:

  • Where required by law, court order, or regulatory obligation.
  • Where necessary for the conduct of your matter, with your prior knowledge (for example, liaison with the Land Department or relevant courts).
  • Where you have given explicit written consent.

This duty of confidentiality continues after the conclusion of the matter and is not affected by the termination of our engagement. Our full data handling practices are described in our Privacy Policy.

8. Professional Standards

Moradok Tham operates in accordance with the professional obligations applicable to legal practitioners in Thailand, including those set by the Lawyers Council of Thailand. Our practitioners are bound by professional conduct rules that govern competence, integrity, and the handling of client matters.

If you have a concern about the conduct of any matter, we encourage you to raise it with us directly in the first instance. Our approach to handling concerns is explained in our engagement letters.

9. Disclaimers

While we take care to ensure the accuracy of information on this website, it is provided for general guidance only and is not a substitute for tailored legal advice. Laws and regulations may change, and individual circumstances vary.

  • This website is provided on an "as available" basis. We do not warrant uninterrupted or error-free access.
  • We are not responsible for the content of external websites linked from our pages.
  • Outcomes in legal matters depend on many factors outside our control. We do not make representations about specific results.

Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable Thai law.

10. Limitation of Liability

To the extent permitted by Thai law, our liability to you in connection with any matter is limited as follows:

  • Our aggregate liability for any claim arising out of or in connection with the services provided shall not exceed the total fees paid by you for the specific service to which the claim relates.
  • We are not liable for indirect, consequential, or special loss, including loss of income, opportunity, or reputation, except to the extent caused by our gross negligence or wilful misconduct.
  • We are not liable for any delay or failure arising from circumstances beyond our reasonable control, including court delays, acts of government, or failure of third-party systems.

11. Indemnification

You agree to indemnify and hold harmless Moradok Tham, its practitioners, and staff from any claims, losses, or expenses (including reasonable legal costs) arising from your breach of these Terms, your misuse of this website, or any inaccurate or misleading information you provide to us in connection with a matter.

12. Termination

Either party may bring an engagement to a close at any time by giving reasonable written notice, subject to the specific terms of any engagement letter.

If you choose to discontinue a matter before completion, you remain responsible for fees and disbursements incurred up to that point. We will provide a clear account of these upon request.

We may decline to continue with a matter where, in the exercise of our professional judgement, it becomes necessary to do so — for example, where there is a conflict of interest or where continuing would be contrary to our professional obligations. In such circumstances, we will provide reasonable notice and assist with the transfer of your file to another adviser if required.

Provisions relating to confidentiality, intellectual property, limitation of liability, and governing law survive the termination of any engagement.

13. Dispute Resolution

These Terms and any engagement between the parties are governed by the laws of the Kingdom of Thailand. The courts of Bangkok have exclusive jurisdiction over any disputes arising out of or in connection with these Terms or our services.

If a concern arises, we ask that you contact us directly in the first instance. We are committed to addressing any issues clearly and promptly. In many cases, a straightforward conversation resolves matters without the need for formal proceedings.

Where a dispute cannot be resolved informally, the parties may agree to submit the matter to mediation before initiating court proceedings.

14. General Provisions

  • Entire Agreement: These Terms, together with any signed engagement letter, constitute the full agreement between the parties in respect of the subject matter, and supersede any prior understanding or representation.
  • Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue in full force and effect.
  • Waiver: A failure or delay in exercising any right under these Terms does not constitute a waiver of that right.
  • Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our obligations where necessary for the continuity of our practice, such as in the case of a professional succession.
  • Notices: Formal notices under these Terms should be sent in writing by email or post to the contact details set out below.

15. Changes to Terms

We may update these Terms from time to time. When we do, the revised version will be published on this page with an updated "Last Updated" date. Continued use of this website following any changes indicates your acceptance of the revised Terms. For active client matters, any material changes will be communicated to you directly.
